Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dyyno, an AI chat assistant and reservation booking service for local businesses available at dyyno.xyz (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of these Terms

By registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of a business or other organization, you represent that you are authorized to accept these Terms on its behalf, and "you" refers to that organization.

2. Description of the Service

Dyyno lets a business owner create an AI-powered chatbot, configure it with their own information (such as business name, description, services, prices, menu, and frequently asked questions), and embed it as a chat widget on their website. The assistant answers customer questions and can capture reservations or bookings on the business's behalf.

The assistant generates responses using artificial intelligence. While we aim for accuracy and ground the assistant in the information you provide, AI-generated replies may be incomplete or incorrect. You are responsible for reviewing the information your chatbot is configured with and for honoring (or declining) any bookings it captures.

3. Accounts and Eligibility

To use most features you must create an account. You agree to provide accurate information, keep it up to date, and keep your login credentials secure. You are responsible for all activity under your account. You must verify your email address before completing onboarding. You may also sign in using Google.

You must be at least 16 years old, and old enough to form a binding contract in your jurisdiction, to use the Service. The Service is intended for business use and is not directed at children.

4. Acceptable Use

You agree not to use the Service to:

  • violate any applicable law or regulation, or infringe anyone's rights;
  • create or operate a chatbot for adult, sexually explicit, or otherwise NSFW businesses or content — Dyyno screens for and blocks such use;
  • publish or generate content that is unlawful, hateful, harassing, defamatory, deceptive, or harmful;
  • upload content you do not have the right to use, or that infringes intellectual property or privacy rights;
  • attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
  • resell, sublicense, rent, lease, white-label, or otherwise make the Service available to third parties as your own product or as part of a competing or substantially similar service;
  • abuse the Service in a way that harms us, our providers, or other users.

One account is for your own business(es). A Dyyno account, and the chatbots created under it, are licensed to you for operating your own business or businesses. Your plan's chatbot allowance lets you run multiple chatbots for businesses you own or operate — it is not a licence to operate a chatbot platform of your own on top of Dyyno, or to resell, sublicense, or white-label the Service as your own product. If you are an agency or consultant who wants to build and manage chatbots on behalf of your own clients, our Agency plan is the intended way to do so; for white-label or reseller arrangements beyond that, contact us at support@dyyno.xyz to arrange a separate written agreement. Absent the Agency plan or such an agreement, third-party/reseller use is not permitted.

We may suspend or terminate accounts that violate this section.

5. Your Content

You retain ownership of the business information, text, and files you provide ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service for you — including sending relevant content to our AI provider to generate replies. You are responsible for the accuracy and legality of Your Content and for the reservations your chatbot accepts.

6. Subscriptions, Trials, and Billing

Dyyno offers a Free plan and paid plans: Starter ($19/month), Growth ($49/month), and Pro ($99/month). Plan features and usage limits are described on our pricing page and may be updated over time.

Payments are processed by Paddle (Paddle.com Market Ltd), which acts as our Merchant of Record. This means Paddle sells the subscription to you as an authorized reseller and handles billing, payment processing, and the collection and remittance of applicable taxes. Your purchase is also subject to Paddle's terms shown at checkout. We never receive or store your full card number.

Paid plans include a 7-day free trial. Unless you cancel before the trial ends, your subscription begins and the plan fee is charged. Paid subscriptions are billed monthly in advance and renew automatically each month until you cancel. By subscribing, you authorize recurring charges to your payment method until cancellation.

7. Cancellation and Termination

You may cancel your subscription at any time from your account or by contacting us. Cancellation stops future renewals; your paid features remain active until the end of the current billing period. Refunds are governed by our Refund & Cancellation Policy.

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. You may stop using the Service and delete your account at any time.

8. Intellectual Property

The Service, including its software, design, branding, and the "Dyyno" name and logo, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Except for Your Content, nothing in these Terms transfers any ownership to you.

9. Third-Party Services

The Service relies on third-party providers — including Paddle for payments, DeepSeek for AI responses, Brevo for email, and Google for optional sign-in. Your use of those features may be subject to the providers' own terms. We are not responsible for third-party services we do not control.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, Dyyno will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Dyyno from any claims, damages, or expenses arising from Your Content, your use of the Service, or your breach of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of Dyyno resides, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction, unless applicable consumer- protection law requires otherwise.
